What is the refugee process?

The refugee process in Canada provides protection to individuals fleeing persecution, armed conflict, or human rights violations. Those who can demonstrate a well-founded fear of persecution based on race, religion, nationality, membership in a particular social group, or political opinions, or who face serious risks to their lives, may be considered protected persons.

Who is eligible to apply for asylum?

Asylum can be requested if:

  • The applicant is already in Canada or submits their application at the border or airport.

  • There is a genuine fear of persecution or danger in their country of origin.

  • They have no safe options to return to their country.

You are not eligible to apply for asylum if:

  • The applicant has a pending application before the Immigration and Refugee Board (IRB).

  • They submit their application from outside Canada.

How is it possible to apply for asylum?

  1. Filing the application: It can be submitted at a port of entry (border or airport) or from within Canada.

  2. Document preparation: Complete the forms and provide evidence supporting the application.

  3. Initial interview: An immigration officer will assess whether the application is admissible.

  4. Hearing before the IRB: At this stage, the case is formally presented along with evidence of persecution or danger.

  5. Decision: The decision may be given on the same day of the hearing or later. If approved, the applicant obtains refugee status and can apply for permanent residence.

What is required to complete the process?

  • Documents proving persecution or risk in the country of origin.

  • A personal statement explaining the circumstances that led the applicant to seek asylum.

  • Additional evidence: Such as letters of support, medical records, or reports from international organizations about the situation in the country of origin.
